A three-man bench maintains High Court findings that the preacher is an unreliable witness.
PETALING JAYA: The Court of Appeal has upheld the decision of the High Court which found controversial preacher Zamihan Mat Zin an unreliable witness in the defamation suit brought by an NGO.
A three-man bench chaired by Rohana Yusof yesterday also ordered Zamihan to pay RM10,000 in costs to Syria Care, whom the preacher had linked to “Shia groups in Malaysia that must be monitored by the government”.
According to a press release issued by Shukor & Associates, the law firm for Syria Care, the Shah Alam High Court allowed the plaintiffs’ claim and awarded them RM50,000 in damages.
The suit was filed against Zamihan and the Star Media Group Bhd based on a report published by The Star Online, which attributed Zamihan to the defamatory article titled “Senseless jihad puts Malaysia as global violence hub, says Home Ministry officer”.
The Court of Appeal also agreed with the findings of fact by the trial judge that Zamihan was an unreliable witness as his answers were contradictory and against his own pleadings.
Justice Wan Ahmad Farid Wan Salleh ordered Zamihan to pay Syria Care RM30,000 in costs.
It also directed Star Media, which was the second defendant, to publish an unconditional apology to Syria Care.
No judgment was given following the publisher’s withdrawal of the article. The Star Online published the unconditional apology on May 17.
Zamihan, who is a Malaysian Islamic Development Department (Jakim) officer, has been placed at the Prisons Department as a deradicalisation officer for terrorism and extremist elements.
He is also president of the Ahli Sunnah Wal Jamaah Association (Aswaja) and principal assistant secretary of the home ministry’s Security and Public Order division.
He courted controversy recently for criticising the Sultan of Johor for taking a stand against the “Muslims-only” laundrette in the state.
He was remanded for two days to assist police who were investigating him under the Sedition Act 1948.
