Court dismisses application against Wisma Tok Guru landowner

husam-musa-court-gavelKOTA BHARU: A Kelantan state assemblyman today failed to obtain an injunction order to prevent the owner of a piece of land in Salor from allowing any party to hold activities in Wisma Tok Guru, a building built on the property by the former owner.

Judicial commissioner Ahmad Bache set aside Salor assemblyman Husam Musa’s application with RM7,000 costs.

In his decision, the judge said the court took into account the defendant Mohd Yasin Yusoff’s right to the land as he had already paid for the property.

Husam, who is also Amanah vice-president, applied for the injunction to prevent Wisma Tok Guru from being disturbed by any quarters until the building ownership status quo had been determined by the court in a hearing on Dec 4.

The issue surfaced when the land which had belonged to former Salor assemblyman, the late Ahmad Rosli Ibrahim, was sold to Yasin, who is also Kelantan PAS executive secretary, for RM700,000. Rosli had named his wife as beneficiary.

Husam, who is still using the building as his office, claimed that the original owner of the land had given him permission to do so.

Meanwhile, PAS sent a notice to Husam to vacate the building by Nov 12. The party said they also planned to hold thanksgiving prayers tonight on the new ownership.

Speaking to reporters, the defendant’s counsel Takiyuddin Hassan said the prayer session would proceed as the party had already obtained a permit from the police.
