State exco man says state government had previously been neutral in the matter but had been convinced to support the residents after getting legal advice.
GEORGE TOWN: The Penang government will support a group of residents in their suit against a developer planning a hill slope project in Sungai Ara.
State executive councillor Jagdeep Singh Deo said the state government was initially cautious about supporting the residents as it was afraid of being sued for compensation by the developer.
“We would like to confirm I have met with the residents in the suit, together with the chief minister and their legal counsel, Gurdial Singh Nijar, on Sept 9.
“We were earlier advised by our legal advisers that if we did not approve special projects submitted to the state government before we took power, we would have to pay compensation. So, we had taken a neutral stance on this.
“But after Gurdial allayed our fears about compensation, we’ve now decided to stand together with the residents in this case,” Jagdeep said at a press conference in Komtar today.
The Sungai Ara residents are fighting developer Sunway City that is proposing to build 600 units of high-rise apartments and bungalows on hill land covering 32.4ha.
Nearly half of the project will be situated on slopes with gradients above 25 degrees.
It was approved by the then municipal council as a special project on Sept 13, 1996.
The Penang Structure Plan prohibits projects on hill land 76m over sea level or hill slopes with a gradient exceeding 25 degrees.
The residents of Sungai Ara had taken their case to the Appeals Board and won.
Later, the developer challenged the board’s decision at the High Court and managed to overturn the board’s decision.
The residents are now taking it to the appellate courts and the case is scheduled to be heard on Nov 13.
